Dividing Finances and Assets

Dividing finances and assets

Most separations involve dividing assets between two parties. The guides below, produced by the Family Justice Council, explain in detail how this is usually approached, including property, pensions and income.

Sorting out Finances on Divorce (2016) — a plain-English guide to how courts approach dividing assets and income where you do not have, or do not need, a lawyer, covering housing needs, capital, income arrangements and pension sharing.

Guidance on Financial Needs on Divorce, 2nd edition (2018) — a more detailed reference document, originally written for the judiciary, on how financial needs are assessed and met following divorce or civil partnership dissolution.

Both guides are designed for people managing their own finances during separation, without necessarily needing a solicitor, though they are also useful if you do have one and want to understand the reasoning behind the advice you are given.

Ongoing support for children

These guides cover capital, property and pensions rather than day-to-day child maintenance. See our Child maintenance and financial support for children page for that.
